Truth About Executive Order No. 1 of 2020 Signed by President Uhuru Kenyatta

The Nairobi Metropolitan Service has also been placed under the Executive Office of the President

President Uhuru Kenyatta has issued Executive Order no. 1 of 2020 titled “The Organization of Government” which supersedes Executive Order No. 1of 2018 (Revised) issued in July 2018.

In the Executive order, the president re-organizes the government, outlines portfolio responsibilities and changes made in the structure of Government, and assigns functions and institutions among Ministries and State Departments

The Executive order reads in part:

IN EXERCISEof the powers conferred by Article 132 (3) (b) of the Constitution, as read with all other enabling Laws, I, UHURU KENYATTA, President and Commander-in-Chief of the Kenya Defence Forces, order and direct:

  1. THAT the Government shall be organized as set out in this Order;
  2. THAT this Order contains portfolio responsibilities and changes made in the structure of Government;
  3. THAT this Order assigns functions and institutions among Ministries and State Departments; and
  4. THAT this Order supersedes Executive Order No. 1of 2018 (Revised) issued in July 2018.

ISSUED under the HAND AND SEALof the President of the Republic of Kenya at State House, Nairobi this11thdayof May, 2020.

Office of The Deputy President

Among the changes to government, the most notable change in the executive order directly affects the Office of the Deputy President. “The Executive Office of the Deputy President” is abolished and the Deputy President put under the “Executive Office of The President”.

When Jubilee came to power in 2013, President Uhuru signed Executive Order no. 1 of 2013 which introduced the “Executive Office of the Deputy President” under “the Presidency”

Nairobi Metropolitan Services (NMS)

The Nairobi Metropolitan Service was created after President Kenyatta and Nairobi Governor, Mike Sonko signed a deed of transfer effectively transferring key functions of the County to the National Government.

The Nairobi Metropolitan Service, under the leadership of the Director General Major-General Mohammed Abdalla BADI has been placed under the new Executive Office of the President which means the Director General reports directly to the President.
